Building notices and orders can sometimes remain unresolved for months or even years, leaving councils to determine what action should be taken next.

Aged Notices and Orders: What Happens Next? will explore the practical and legal issues that arise when councils are dealing with longstanding or outstanding building notices and orders.

The session will consider how older matters can be reviewed, how their current status can be determined, and what options may be available to councils when deciding how best to progress or resolve them.

Krista will discuss considerations including:

  • determining the current status of older enforcement matters
  • identifying what information and documentation may need to be considered
  • assessing appropriate next steps
  • considering the options available to councils to progress longstanding matters
  • practical and legal considerations when managing unresolved compliance issues.

The session will have a strong practical focus for Municipal Building Surveyors and council officers responsible for managing building compliance and enforcement matters.

About the presenter

Krista Weymouth, Special Counsel, Weir Legal and Consulting, has almost 20 years’ experience.

Prior to joining Weir Legal and Consulting, Krista was General Counsel for a state government statutory authority. She has also had extensive experience advising local, State and Commonwealth regulators at a large law firm and at the Australian Government Solicitor.

During her time in private practice, Krista completed a number of secondments with regulators, including in the building and health sectors.

Krista conducts prosecutions for a range of state and local government clients. She appears regularly in tribunals and courts and presents on regulatory matters to a broad range of clients.

Krista recently advised a new Victorian regulator on establishing its initial policies and procedures to enable it to commence operations. She has also been involved in a number of reviews for government bodies assessing the adequacy of existing laws and the effectiveness of policies and procedures.
