VMBSG Building Act Compliance & Enforcement Training

One-day in-person training event

VMBSG is pleased to present this one-day, hosted by Melbourne City Council, in-person Building Act Compliance and Enforcement Training session for council officers involved in building compliance, enforcement, inspections and authorised person functions.

The training will be delivered by Weir Legal and Consulting together with Ryt Business Solutions, bringing together legal expertise and practical enforcement experience.

This full-day session will provide a practical overview of key compliance and enforcement issues under the Building Act, with a focus on the tools, processes and decision-making required by councils when dealing with non-compliance.

The training is designed to be hands-on, relevant and directly connected to the day-to-day work of Municipal Building Surveyors, building inspectors and other council officers involved in compliance and enforcement. It will be particularly useful for officers who need to understand not only what enforcement powers are available, but how and when to use them appropriately.

Topics covered

The session will cover:

  • common enforcement issues for local council building departments
  • delegations and authorisations under the Building Act
  • Part 8 notices and orders, including common enforceability issues
  • planning inspections and enforcement activity
  • risk management and situational awareness
  • powers of entry, including procedures, search warrants and execution
  • gathering evidence, including cautioning, witness statements and site inspections
  • practical evidence-gathering skills, including note taking, rapport building and conflict management
  • a workshop exercise using a realistic fact scenario
  • considerations when deciding whether to prosecute, including risks, alternatives and court orders.

The day will also include an interactive session to reinforce key learnings and provide participants with the opportunity to test their understanding in a practical and anonymous format.

Learning outcomes

By the end of the training, participants will have a stronger understanding of:

  • the compliance and enforcement tools available under the Building Act
  • the importance of correct delegations, authorisations and decision-making processes
  • how to plan inspections and enforcement activity safely and effectively
  • the practical requirements for powers of entry, search warrants and evidence gathering
  • common issues that can affect the enforceability of notices and orders
  • how to approach potential prosecution decisions, including alternatives and associated risks
  • how to apply key enforcement principles to realistic council-based scenarios.

This training is suitable for Municipal Building Surveyors, building inspectors, authorised persons, compliance officers, enforcement officers and other council staff involved in building compliance and enforcement functions.
