Practical overview of Section 64 and Section 68 of the Building Act 1993 and relevant considerations under Building Regulations 2018

Presented by Maddocks Lawyers for VMBSG.

This online training session, presented by Vujan Krunic and Simone Holding from Maddocks Lawyers, will provide VMBSG member councils with a practical overview of section 64 and section 68 of the Building Act 1993, together with relevant considerations under the Building Regulations 2018.

Maddocks has prepared a policy and procedure document, along with supporting templates, to assist Victorian councils when considering applications for temporary occupation approvals under section 64. The document outlines the purpose of the process, the regulatory framework, the exercise of discretion, safety and amenity considerations, application procedures, conditions, written approvals, record keeping, refusals, amendments, cancellations and appeals.

The session will step through the documents and explain how they are intended to be used in practice. Vujan and Simone will also work through several real-life scenarios and discuss common issues that may arise for Municipal Building Surveyors and council teams. The session will conclude with a Q&A, giving attendees the opportunity to raise questions and discuss practical examples from their own council experience.

Outcomes: what you will understand

By attending this online training session, VMBSG member councils will gain a practical understanding of:

  • the purpose and application of section 64 and section 68 of the Building Act 1993
  • relevant considerations under the Building Regulations 2018
  • how councils may approach applications for temporary occupation approvals
  • the regulatory framework that supports the process
  • how discretion may be exercised when considering applications
  • key safety and amenity considerations
  • application procedures and supporting documentation
  • the use of conditions, written approvals and record keeping
  • how refusals, amendments, cancellations and appeals may arise
  • how the Maddocks policy and procedure document and supporting templates are intended to be used in practice
  • common practical issues that may arise for Municipal Building Surveyors and council teams
  • how real-life scenarios can help guide consistent, defensible decision-making

Why this all matters to you

Temporary occupation approvals can raise complex questions for Municipal Building Surveyors and council building teams.

When considering applications under section 64, councils need to balance practical requests with the requirements of the legislation, the intent of the regulatory framework, and broader issues of safety, amenity, risk and accountability.

This session is designed to support councils with a clearer, more consistent approach to these matters. By stepping through the policy and procedure document, supporting templates and real-life scenarios, attendees will be able to better understand not only what the process requires, but how it can be applied in practice.

The training will help council teams strengthen their internal processes, improve consistency, support better record keeping and make decisions that are clear, well-reasoned and defensible.

The Q&A component will also give attendees the opportunity to raise practical examples from their own council experience and explore common issues with the presenters.
